PC Defender EULA – License Agreement & User Rights

IMPORTANT — PLEASE READ CAREFULLY

By installing, copying, or using the licensed software, you agree to the terms outlined in this EULA. If you do not agree with these conditions, do not install or use the software. You may return the software within 30 days for a full refund, minus shipping, handling, and applicable taxes—provided that the software has not been installed, accessed, or used in any form.

If you are a resident of the United States, or a U.S. citizen purchasing the licensed software, please note that this End-User License Agreement (EULA) includes a class action waiver (see below) and requires that all disputes with PC Defender be resolved through binding arbitration (as described in the “Dispute Resolution” section below).

These provisions may affect your legal rights under this EULA. You retain the right to opt out of both binding arbitration and the class action waiver, as described below.

License Terms

The term “licensed software” refers to all components provided under this EULA, including:

Computer information and third-party software licensed to PC Defender for inclusion within the software.
Written materials, manuals, or digital files related to the licensed software (“Documentation”).
Any upgraded, modified, enhanced, or updated versions of the software, along with all additions or copies (“Updates”).
Any reproduced, duplicated, or redistributed materials included as part of the licensed software package.

Installation and Activation

Unless the licensee has purchased a site license agreement, only one copy of the licensed software may be installed and/or used per user license included with PC Defender. To determine how many user licenses are included, the licensee should refer to the product packaging or, in the case of electronically downloaded software, the order receipt. If additional user licenses are required, they may be purchased through the user portal on our website at the prices listed online. The licensee is solely responsible for any costs incurred during installation.

The licensed software includes technical measures designed to prevent unauthorized or illegal use. Enforcement technology may be used to limit the number of installations and uninstallations on devices, as well as restrict the number of computers on which the software can be used. These measures ensure compliance with this EULA and prevent exceeding the number of purchased user licenses.
Activation may be required as described during installation or in the product documentation. To activate the software, you may be required to enter a serial number and create an account with PC Defender.
(Trial versions may not require a serial number, but usage duration and/or features may be restricted.)
If activation is not completed within the time frame specified in the documentation or during installation, the software may stop functioning until activation is successfully completed. Once activation is finished, full functionality will be restored.

The licensed software is intended for use on physical devices such as desktop and laptop computers. Full functionality may not be available when running the software on virtual machines.

Internet Access

The licensed software may require an active internet connection to enable full functionality and access all available features.

Please review the specific terms below, which exclude warranties and limit our liability for interruptions, slow connectivity, or unavailability of internet services.

Protection of Personal Data

By using the licensed software, you agree that PC Defender may collect and use certain information about you and your interaction with the software, as outlined in the PC Defender Privacy Policy.
You consent to PC Defender collecting, using, transferring, processing, and managing information related to your account and any registered devices or computers in order to provide the software and its features.

PC Defender may also gather technical and diagnostic data regarding your usage to support, improve, and enhance its products and services.

You also consent to the transfer of this information to the United States and/or other countries for storage, processing, and use by PC Defender, its affiliates, and service providers.
By providing this consent, you allow PC Defender, its partners, and its licensors to collect, use, transfer, process, and manage your location and account data to enable or improve these functionalities and services.

Copies

The licensee may create only one copy of the licensed software, and only for backup or archival purposes. Documentation may not be duplicated under any circumstance.

Transfer

TThe licensee may not sell, assign, sublicense, rent, lease, lend, or otherwise transfer the licensed software or the rights granted under this EULA without prior written consent from PC Defender.

Use

The license granted under this EULA is non-exclusive. The licensee may not use the licensed software in any manner other than as explicitly permitted under this agreement.

Prohibited Uses

The licensee agrees not to

Modify, alter, adapt, or translate any part of the licensed software.
Create derivative works based on any portion of the licensed software.
Reverse-engineer, decompile, disassemble, or attempt to discover the source code of the licensed software.
Continue using an older version after receiving a replacement or updated version, and must destroy old versions upon upgrade.
Use the licensed software in the operation of aircraft, ships, nuclear facilities, life-support systems, communication systems, or any equipment where software failure could result in injury, death, or environmental damage.
Remove or obscure copyright notices, trademarks, or proprietary labels belonging to PC Defender or its licensors.
Use the licensed software to provide services for third parties under facility management, time-sharing, service provider, or service bureau arrangements.
Use the licensed software in any way not expressly authorized by this EULA.

Software Updates

If the licensed software is an update to a previous version, you must hold a valid license for that earlier version. By receiving an update, you agree to terminate all rights to use any previous versions of the software. However, you may temporarily use the older version only to assist with the transition to the updated release.
Once an update is issued, PC Defender may discontinue support for prior versions without providing notice.

Content Updates

PC Defender may periodically deliver updates to its software content, including virus definitions, URL databases, rule sets, driver database updates, and vulnerability data. These updates are collectively referred to as Content Updates.
PC Defender reserves the right, at its sole discretion and without prior notice, to add, modify, or remove features—including content updates—from the licensed software at any time.

Support

This EULA does not obligate PC Defender to provide technical support for the licensed software.
However, additional support services may be made available for a separate fee, depending on offerings provided by PC Defender during the term of this agreement.

Applicable Law

Nothing in this agreement is intended to prevent you, as a consumer, from exercising your rights under applicable consumer protection laws.

This EULA is governed by and interpreted in accordance with the substantive laws of Germany, to the extent permitted by consumer law.
It is not governed by conflict-of-law principles or the United Nations Convention on Contracts for the International Sale of Goods, which is expressly excluded.

Ownership / Restrictions

ABOUT THIS SOFTWARE

The manufacturer reserves all rights not expressly granted to the user under this license. It is strictly forbidden to modify, adapt, translate, decompile, or attempt to discover the application’s source code in any way, including through reverse engineering.

NOTICE REGARDING MULTIMEDIA FILES INCLUDED WITH THIS SOFTWARE

The manufacturer and its licensors retain all intellectual property rights to any multimedia files included with the software, such as images, audio files, and video files.
Use of these materials is limited to personal use only; any other use—especially:

Commercial use
Use of the software for purposes other than its intended functionis strictly prohibited.

Using this software to create copies or adaptations of copyrighted works—such as ringtones, screensavers, recordings, videos, images, etc.—without the prior consent of the copyright holder constitutes a violation of law.
Such infringements may result in civil and criminal penalties.

Copy Protection – Activation Keys – Verification Measures

The software may include technical protection mechanisms designed to prevent unauthorized duplication. Users must not bypass, disable, or attempt to circumvent these protections.

To activate or continue using the software beyond a certain period, users may be required to enter an activation key provided earlier.

Users acknowledge that the activation key remains the exclusive property of the manufacturer, is considered strictly confidential, and may not be shared with third parties.

Users agree to store and protect the activation key securely at all times.

As part of the verification process, the software may validate the activation key used on the user’s device when an internet connection is established.

During this check, only statistical data is transmitted to the manufacturer—no personal information or data unrelated to the activation key is sent to the manufacturer or any third party.

Data Transmission Over Communication Networks

The software enables sending and receiving data over communication networks.

However, when transmitting data through external networks and communication devices, the confidentiality and integrity of the data cannot be guaranteed.

All data transmission is performed solely at the user’s own risk.

The manufacturer assumes no liability for damages arising from transmission errors, data interception, data reading by third parties, or loss of data during transmission.

Duration

This license is granted for an indefinite period.

It will terminate automatically and without notice if the user violates any provision of this agreement.

Upon termination, the user must immediately delete all copies of the software and any related documentation.

Warranty Limitation

The manufacturer guarantees that the physical software media will be free from defects in materials and workmanship under normal use for a period of 90 days from delivery or purchase.

In case of defect, the manufacturer may, at its discretion, either replace the defective media or refund the purchase price.

The manufacturer guarantees that the software generally conforms to the accompanying documentation but does not guarantee error-free functionality or that it will meet all user requirements.

No other express or implied warranties are provided under this license.

Severability Clause

If any provision of this agreement is found to be invalid, the remaining provisions shall continue to remain fully effective.
